IDAHO FALLS – A woman appeared in court Monday after being charged with multiple drug-related felonies.
Rebecca Muir, 34, was charged with felony drug trafficking of heroin, felony possession of a controlled substance and misdemeanor use or possession of drug paraphernalia after police performed a house check.
Bonneville County Sheriff’s deputies performed the house check on July 7. They were originally investigating a man who lived in the home. During their search, deputies learned Muir also lived in the home, and they discovered suspected narcotics in the residence, according to court documents.
Deputies discovered “a box with paraphernalia, a small black container that had more paraphernalia, and a small black baggy in a pill bottle with a black tar-like substance,” reportedly on Muir’s side of the bed.
Officers found another baggy with a black tar-like substance on the man’s side of the bed, which was “tucked between the mattress and box spring, next to a paycheck with the man’s name on it.”
Officers interviewed Muir, who told them that all of the drugs and paraphernalia they found were hers. When asked how drugs got on the man’s side of the bed, she told officers that she “was making the bed, and it must have flipped over.”
When asked how it got tucked under the mattress, she said she had no idea there were any drugs under the mattress. She also told police that she had some foil in her purse, and when officers searched it, they found another small baggie of a “black tar substance.”
When deputies tested the suspected drugs, they came back positive for heroin and methamphetamine.
The man has not yet been charged, and it is unclear if he will be.
A warrant was issued for Muir’s arrest on Aug. 9, and she was booked into the Bonneville County Jail. Her bond was set at $40,000. She posted surety and was released.
Though Muir has been charged with these crimes, it does not necessarily mean she committed them. Everyone is presumed innocent until they are proven guilty.
Muir is scheduled for a preliminary hearing on Aug. 26. If convicted, she could face up to life in prison.
